Changes under consideration in the 2026 Budget Law
Four amendments reopen the dossier. Among the hypotheses: reactivate the 2003 amnesty or introduce a new amnesty for abuses completed by 30 September 2025.
- Two amendments aim to reopen the scope of the 2003 amnesty (the “third amnesty”), with strong interest in regions such as Campania.
- An alternative amendment provides for a new “broad-based” amnesty for all unauthorised works completed by 30/09/2025 (canopies, porticoes, light appurtenances, unauthorised renovations), even in zone A, if there is no increase in volume/gross usable area.
- The following would remain excluded from the 2003 restart: restricted areas, buildings of cultural value, forests affected by fire, buildings that cannot be made earthquake-proof.
- The regions would only have a decisive role in the 2003 reopening; the new 2025 amnesty, as formulated, does not indicate regional boundaries or explicit exclusions.
The two options on the table
1) Reopening of the 2003 amnesty
- Scope: irregularities completed by 31 March 2003.
- Limits: volume increases of up to 30% (within 750 cubic metres) or new residential buildings of up to 750 cubic metres (up to 3,000 cubic metres in total).
- Confirmed historical exclusions: areas subject to restrictions, cultural heritage sites, burned wooded areas, buildings that cannot be made earthquake-proof.
- Role of the regions: local implementing laws to define conditions, procedures and limits.
2) New 2025 amnesty (“broad” hypothesis)
- Time frame: works completed by 30 September 2025.

What is included:
- Appurtenances (canopies, porticoes, balconies).
- Accessories and unauthorised renovations, if there is no increase in surface area/volume, except for an increase in the gross floor area.
- Restoration, conservative renovation, extraordinary maintenance, even in zone A.
- Critical issues: the draft lacks territorial limits, the role of the Regions and exclusions for restricted areas → very broad scope of application and still to be clarified.
Potential impacts on the market
- Massive regularisation of minor discrepancies → more properties available for sale and faster completion times.
- Possible boost to demand for units that are currently “blocked”.
- Risk of overloading municipal technical offices and variable processing times.
- Accurate due diligence is necessary to avoid false expectations.
What to do now (before the law changes – or does not change)
- Map the discrepancies: collect building permits, SCIA/CILA (certified notification of commencement of works/certified notification of commencement of works without planning permission), concessions, floor plans, occupancy permits.
- Request an Integrated Technical Report (building & cadastral compliance) to understand what can be remedied and how.
- Avoid unauthorised ‘repair’ work: it could complicate future amnesty procedures.
- Prepare photos, surveys and documentation: these will be required in the event of amnesty applications.
- Assess the economic impact (fines, charges, design) to estimate the actual cost-effectiveness.
Frequently asked questions
Can I sell now, counting on the amnesty?
Yes, but only if the buyer accepts the condition and the notary considers the discrepancy to be non-blocking. The prudent approach is to regularise first or make the contract conditional on the outcome of the procedure.
Will restricted areas be included?
Not in the 2003 reopening. In the new 2025 amnesty, as drafted, there are no explicit exclusions: this is a point that may be restricted in Parliament.
How long will it take?
It depends on the final text, regional regulations (if any) and the workload of the offices. Taking action now with technical due diligence reduces the time required when/if the regulations come into force.
